I think that this very much depends on what role these individuals are being employed in. If their role is to advise other employees and act as a representative of the employees at H&S Committee level then I don't see a problem.

On the other hand if they are being employed to advise the Management and the workforce on compliance with legislation then I think that there could be a problem.

After all qualifications are not a guarantee of competency which is what the law requires.
